keTIDAKTENTUan - carutan untuk lawyer kerek!

oooooowhhh... malas nya aku nak fikir pasal karenah lawyer ari ni... memang KEREK nk mampuih! (bleh ak, aku rase cam nak mencarut aje!!!!!!!!!)

tapi xpe sabar2...

dia ingat dia tu lawyer dia pandai? ..... hallo! it just a small problem lah, y nak besar2 kan?... x ade kerja laen ke?

kadang2 aku rase lawyer yang sorang ni memang berLAGAk giler...

just a small mistake from the bank... bukannya menyebabkan client ko rugi berjuta-juta ringgit pown! Kalo stakat RM 190++ je weh.... nak bising2 plak...

The Perak's Political Crisis

My first serious entry perhaps?

Bila asyik selalu diperkatakan tentang krisis politik/perlembagaan Perak oleh media massa, x kira lah media arus perdana ataupun media "indie", I'm sure that most of Malaysians macam dah jelik with the politicians, and of course the political party itself...

Its all about the perebutan kuasa... I just hate it actually.... please stop it.... we are now in the difficult state of world economy.... focus on the Rakyat please!

Btw.... back to the case.... today it is believed that the Appeal Court will deliver its judgment bout the position of perak's menteri besar...

Btw, tetibe teringat class Prof. Shad Saleem Faruqi & Mr. Nazim Ganti Shaari time degree kat FoL UiTM... Class Constitutional Law I & II....

So regarding the case teringat plak kat satu case yang kat Sarawak dulu tu...

STEPHEN KALONG NINGKAN.

Dalam kes ini, the court hd decided that satu-satunya cara seseorang Ketua Menteri (di Sarawak) hilang kepercayaan adalah dengan vote of no confidence ‘undi ketidakpercayaan’ di dalam Dewan Undangan.

Di dalam kes Ningkan, ianya telah membezakan (distinguished) kes Adegbenro v Akintola atas lima (5) sebab iaitu:

(a) Kes Akintola jelas, dari segi matematik, bahawa lebih daripada separuh ‘House’ di Nigeria tidak lagi menyokong ‘Premier’;

(b) Kes Akintola mengunakan perkataan ‘support’ manakala kes Ningkan, ianya menggunakan perkataan ‘confidence’, dan ‘confidence’ disini adalah ‘term of art’, justeru itu ianya mengkehendaki ‘undi kepercayaan’;

(c) Di Nigeria, jelas Gabenor mempunyai kuasa tersurat untuk memecat ‘Primier’ jika beliau tidak lagi mempunyai kepercayaan;

(d) Di Nigeria, Gabenor mempunyai kuasa untuk menganalisa situasi ‘as it appeared to him’; dan

(e) Di Nigeria, semua Menteri (termasuk ‘Premier’) memegang jawatan selama diperkenankan ‘at the Gabenor’s pleasure’.

So atas sebab-sebab fakta adalah serupa di dalam kes Nizar v Zambry dengan kes Ningkan, maka kes Ningkan adalah terpakai dan masih lagi merupakan ‘good law’.

Tapi dalam masa yang sama kita perlu ingat bahawa kes Ningkan adalah diperingkat Mahkamah Tinggi, oleh itu, Mahkamah Rayuan tidak terikat. Tetapi, kes Akintola adalah kes ‘privy council’, iaitu sama tingginya seperti di House of Lords di England

Btw... LAW is too subjective.... It's a matter of the interpretation...

Sama-samalah kita nantikan keputusan Mahkamah Rayuan petang ini...

PUTRAJAYA, 22 Mei - Tiga Hakim Mahkamah Rayuan, Hakim Datuk Md Raus Shariff, bersama Hakim Datuk Zainun Ali dan Hakim Datuk Ahmad Maarop, petang ini sebulat suara memberikan keputusan memihak kepada rayuan Dr. Zambry untuk ketepikan keputusan Mahkamah Tinggi Kuala Lumpur.

Pada 11 Mei lalu, Hakim Mahkamah Tinggi Datuk Abdul Aziz Abdul Rahim telah memutuskan bahawa Nizar tidak melepaskan jawatan Menteri Besar kerana beliau tidak kehilangan kepercayaan majoriti anggota Dewan Undangan Negeri Perak.

Hakim Datuk Md Raus Shariff memberikan alasan benarkan permohonan Dr. Zambry bahawa kuasa membubarkan Dewan Undangan Negeri (DUN) adalah hak mutlak Sultan Perak.

Perkara 16.6 Undang-undang Tubuh Negeri Perak jelas menyatakan bahawa jika Sultan tidak memberi perkenan pembubaran DUN maka Nizar mesti meletakkan jawatan dan tiada peruntukan yang memerlukan supaya undi tidak percaya dibuat dalam DUN bagi gugurkan Menteri Besar.

Dengan ini, bermakna Dr Zambry terus kekal sebagai Menteri Besar Perak yang sah.

Kris Allen Takes The `American Idol' Title

Folksy singer Kris Allen is the new "American Idol," turning judges' favorite Adam Lambert into an also-ran.

Host Ryan Seacrest said on Wednesday's finale that nearly 100 million votes were cast for the finalists. The 23-year-old Allen, a student from Conway, Arkansas, bested the 27-year-old Lambert, a theater actor from San Diego.

The two-hour finale included performances by the Black Eyed Peas, Cyndi Lauper, Carlos Santana and Rod Stewart. Lambert performed with Kiss and Allen dueted with Keith Urban.

Before the announcement, the two finalists dueted on "We are the Champions" with the surviving members of Queen.

Allen gets a record contract along with his "American Idol" title.

Abis aje game trus kuar lepak2 kat KL.... At first ingat nak g Sungai Pasir untuk cari ENTITI tapi cam x ade je... so gerak ar g Bangsar n had a supper there... Just ate a plate of fried kueh teow.

After that we headed to Chow Kit Road and Dataran Merdeka... lepak2 sekejap sambil menikmati pandangan malam... phewittttt!

Hampir 4 pagi, then kitaorang gerak balik S.Alam but sebelum tu g Subang Jaya... Ingat nk g makan kat situ... tp cam dah tutup aje Restoran tu...

So dengan perasaan yang hampa, terpaksa ar kitaorang g minum kat Sek. 21 S. Alam...

Pukul 6 pagi lebih baru sampai umah...

Danga City Mall Outing

Wah, cam gempak ek poster kat atas ni? Cam best ja sale tu...

So ari ni me n Boy g ar kat situ... saje je tengok-tengok ape yang menarik kat sana... Since si Boy nak beli baju, if i'm not mistaken untuk wedding ceremony adik dia.... yang peliknya kenapa temanya warna MERAH? Oriental theme perhaps?

Ooops terlupa nak cakap... at first aku memang malas giler lah kot nak keluar... ingat nak stay at home n kemas bilik aja... so just let Along n Boy yang pergi...

Suddenly, received SMS from Along to inform me yang kereta Kak JY (Jamaliah Yaacob) rosak n ask me untuk turun and tolong btulkan.... so may reaction just.... WUT? keta tu wat hal lagi?...

So aku pun turun and tolong btulkan ape yang patut... (actually just tolong pasangkan balik tayar..., itupun kejap aja. Lainnya Boy n Along yang wat... poor Along, basah2 baju dia dek peluh yang mencurah-curah).

Since baju dia dah basah, he just then cancelled the outing... malas katanya!

So since Along x nak outing, then aku pun temankanlah si Boy... takut merajuk plak nanti...hu3!

ramblings at office

Just came back from JB High Court as ade hearing before the Yang Arif Dato' Hue Siew Kheng... but the petitioner's lawyer ask for another date... so tangguh lagi kes ni... aaaarrrrrgggghhhhh! but before that I had 1 in chamber's matters... nasib baek Dato' Hue tu baik n x adela dia tanya banyak2.

tp okey jgak kes yang hearing kat open court tu tangguh, bleh la aku blik ofis awal... he3!

so skarang aku kat ofis ar ni.. ingat nak siapkan monthly report tp cam malas lah plak. and my plan as today adalah untuk siapkan kerja2 aku yang dah lama tertangguh tu...

But, even fed up pun tetap jgak nk kna siapkan fail-fail ni semua...

Out with Intan

I woke up around 9 a.m and take shower... then on9 for a while kat facebook tu... btw sindrom malas bukak friendster semakin menjadi-jadi sejak akhir2 ini... uish bapak skema ayat aku!

yeah, serious! lately my view more to facebook than friendster or tagged.... don't know why!

so seperti dijanjikan, around 3pm intan came to my house n pick me up before we headed to AEON Bukit Indah.... and u know what? all the way, she keep babbling bout her problems!

Bila dh sampai, we just headed to its foodcourt n makan! OMG i'm just so hungry!

my choice! look yummy but bolehla...

lepas je makan, we just walk for window shopping... n sampai kat one outlet ni, intan try la satu jeans, u know what... she claiming that dia dah kurus :-), i just.....LOL....

dlm kul 6 lebih then we just gerak kluar n balik coz she r going to taman U to see her parents.

btw, i'm going to pick up my housemate, Boy at the Senai Airport, he may arrive arround 11pm from K. Kinabalu... harap2 flight dia x delay....thanks to Laila coz sanggup temankan aku drive g sana... so bye2....

Catatan 1 Mei!

Aku kebosanan!!!!!!!

Serious beb, had nothing to do... nasib baek ziera my jiran merangkap my colleague ajak aku g tengok movie, citer WOLVERINE... so ari jumaat, pas solat dlm kul 2.30 aku n Along (my housemate) gerak dr umah n sampai kt City Square JB (CS) dlm kul 3 lebih, nasib baek citer tu start kul 3.30.. itula along kn dh cakap susah nk dpat bas..(actually tggu jgak ar bas bout 15 mins, bt since dh x de bas, naik teksi je lah).

sampai kt sana, try to call Moon n asked for her location... then x sampai 5 mins, terpacul lah Cik Moon, Laila n Ziera kat situ...

so, klu korang tanya ape pndapat aku tentang citer ni... my answer would be definitely "BOLEHLA", btw it just not my genre! bolehla klu untuk nk isi masa lapang... hu3...

abih citer, kitaorang g makan (actually aku n along ja coz ziera, moon n laila dh decide nk g Plaza Pelangi), ingat cam nk follow diaorg, bt since Along x nk pergi... then i just follow him...

tp sbnarnya we just take dfrent direction... and I walked alone!

We arrived at home around 8 p.m n I take shower before headed to Ziera, Moon n Laila's house tuk layan Final OIAM season 3... and the result is predictable, TOMOK wins the competition (Kash! U must be very hepi yeah!)
